By using this website and submitting a mastering project, you are agreeing to the terms and conditions listed below.

Our Music Mastering Services

Trackbastardz shall provide professional music mastering services. The services may include, but are not limited to, audio mastering, equalization, compression, limiting, sequencing, and other related services to enhance the audio quality of your music recordings.

Trackbastardz shall deliver the final mastered audio files to Client in the format agreed upon by the Parties within 14 days of receiving the stems files under the specifications defined by Trackbastardz.

We allow up to 2 revision requests from once initial audio mastering has been delivered to you.

Confidentiality

Trackbastardz shall treat all information you provide as confidential and shall not disclose or use such information for any purpose other than providing the music mastering services under this Agreement, unless required by law.

Your Recordings

By “Recording(s)”, we mean one or several musical sound or audiovisual recordings (including, unless otherwise stated herein, in the case of sound recording(s), any music, lyrics, and instrumental and/or vocal performances recorded thereon, including any Samples as may be incorporated therein pursuant to the Samples Licence, as the case may be, and in the case of audiovisual recording(s), any sound recording(s) reproduced thereon and any script, direction, music and lyrics or other works, any likeness and/or voice, and any visual, audiovisual, instrumental and/or vocal performances recorded on such audiovisual recording(s) or any sound recording(s) reproduced thereon) which is uploaded on this website.

Intellectual Property

You represent and warrant that you have the necessary rights, licenses, and permissions to provide your Recording(s) to Trackbastardz for mastering. Trackbastardz shall retain no ownership or rights to the Recording(s) provided by Client, except for any pre-existing intellectual property owned by Trackbastardz that would be incorporated into the final mastered audio files delivered to you.

Grant of Rights

Trackbastardz works for and on your behalf. So you are NOT assigning or transferring us any copyright or ownership rights on your Recording(s), but only granting us the non-exclusive rights and licenses described in this Agreement.

To allow us to provide you with our music mastering service, you nevertheless grant us all the rights necessary for the mastering of your Recordings and any associated Metadata. More precisely, you grant us the non-exclusive, sub-licensable right and license, throughout the world, to:

Reproduce and communicate your Recording(s) to you and our engineering team by telecommunication (including making your Recording(s) available to you and our engineers by wire or wireless means in such ways that you and members of our team may access your Recording(s) from any place and at any time individually chosen by you or them), in any formats and through any media (now known or existing in the future), including, without limitation, permanent, temporary, limited and portable digital downloads, interactive, semi-interactive or non-interactive streaming, and cloud services;
To use all name(s), likenesses, voice, artwork images, artist name, trademarks, song and album titles, biographical and other information provided by you (in Metadata or otherwise) in connection with the Recording(s). We reserve the right using your name or likeness as well as metadata as an endorsement of our Services after it has been publicly released by you; You may revoke such authorization at any time by way of written notice to Trackbastardz sent by email to mastering@trackbastardz.com, in which case, Trackbastardz shall remove your Recordings from said readers lists within 30 business days of receipt of the written notice from Trackbastardz;

The rights, licenses, and guarantees that you grant us do not cover the exploitation or communication to the public of any exclusive right over any musical work (music with or without lyrics) included in your Recordings.

Credit

You hereby agree to do your best efforts to credit “mastered by Trackbastardz” when using the audio mastering delivered by Trackbastardz.

Project Rejection

Trackbastardz reserves the right to refuse your mastering project. In case of such refusal, Trackbastardz will reimburse you in full the amount you may have already paid for the refused project.

Limitation of Liability

Trackbastardz’s liability for any claims arising out of this Agreement shall be limited to the total amount paid for the music mastering services under this Agreement. Trackbastardz shall not be liable for any indirect, incidental, consequential, or punitive damages.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Québec, Canada. Any disputes arising out of or in connection with this Agreement shall be resolved exclusively by the courts of Montréal, Québec, Canada.

Entire Agreement

The terms listed on this page constitutes the entire understanding between you and Trackbastardz with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written, relating to Trackbastardz music mastering services.
